1. Scope
This Acceptable Use Policy ("AUP") governs your use of the Allospend consumer service, the Allospend iOS mobile application, the Allospend website at https://allospend.app, Dummii NFC stickers, and related services (collectively, the "Service") operated by Allospend Technologies LLC ("Allospend," "we," "us"). The AUP is incorporated into and forms part of the Terms of Service. Capitalized terms not defined here have the meanings given in the Terms.
2. Prohibited Uses
You may not use the Service, directly or indirectly, to:
2.1 Financial Crime
- Engage in money laundering, terrorist financing, sanctions evasion, or the financing of proliferation of weapons of mass destruction, in violation of the Bank Secrecy Act (31 U.S.C. §§ 5311–5336), the USA PATRIOT Act (Pub. L. 107-56), OFAC sanctions (31 CFR Parts 501–598), and 18 U.S.C. § 1956 / § 1957.
- Structure transactions to evade currency-transaction reporting (31 CFR § 1010.311).
- Transmit, receive, or facilitate payments involving stolen instruments, stolen credit cards, stolen bank credentials, or unauthorized access devices (18 U.S.C. § 1029).
- Engage in wire fraud, mail fraud, or bank fraud (18 U.S.C. § 1343, § 1341, § 1344).
- Operate, promote, or facilitate a pyramid scheme, Ponzi scheme, multi-level-marketing fraud, or advance-fee fraud (18 U.S.C. § 1348).
- Engage in insider trading, market manipulation, spoofing, or layering in violation of the Securities Exchange Act of 1934 § 10(b) (15 U.S.C. § 78j(b)) and Rule 10b-5 (17 CFR § 240.10b-5).
- Conduct unlicensed money transmission in violation of 18 U.S.C. § 1960 or any state money-transmitter law (e.g., Mo. Rev. Stat. § 415.400 et seq. for Missouri).
2.2 Illicit Content and Goods
- Distribute, advertise, or sell controlled substances, prescription medications without valid verification, illegal drugs, or drug paraphernalia in violation of the Controlled Substances Act (21 U.S.C. § 801 et seq.) and the Food, Drug, and Cosmetic Act (21 U.S.C. § 301 et seq.).
- Sell firearms, ammunition, explosives, or other weapons in violation of the Gun Control Act of 1968 (18 U.S.C. § 921 et seq.), state law, or applicable local regulation.
- Sell stolen goods, counterfeit goods, pirated media, or goods that infringe a third party's intellectual property rights (17 U.S.C. § 501, 15 U.S.C. § 1114).
- Solicit or facilitate prostitution, sex work, escort services, or adult sexual services.
- Solicit or facilitate illegal gambling, sweepstakes fraud, or sports-betting in violation of the Unlawful Internet Gambling Enforcement Act (31 U.S.C. §§ 5361–5367) and applicable state law.
- Sell tobacco, vaping products, or alcohol without verified age and licensure.
2.3 Abuse, Exploitation, and Harm
- Engage in the sexual exploitation of children, including the creation, distribution, or possession of child sexual abuse material ("CSAM"), in violation of 18 U.S.C. § 2251, § 2252. Allospend reports detected CSAM to the National Center for Missing & Exploited Children (NCMEC) under 18 U.S.C. § 2258A.
- Engage in hate speech, threats, stalking, doxxing, or harassment, in violation of 18 U.S.C. § 875 and applicable state stalking / cyber-harassment statutes.
- Incite violence, genocide, or terrorism, in violation of 18 U.S.C. § 2332A, § 2339A.
- Solicit, transmit, or store malware, ransomware, phishing kits, or credential-stuffing lists.
2.4 Intellectual Property and Security
- Infringe copyrights, trademarks, patents, or trade secrets, or facilitate such infringement.
- Reverse engineer, decompile, disassemble, jailbreak, or otherwise attempt to derive source code from the App, except as expressly permitted by applicable law.
- Circumvent, disable, or otherwise interfere with security-related features, including rate-limiters, fraud-detection systems, and the NFC sticker pairing protocol.
- Use automated means (bots, scrapers, headless browsers) to access the Service except as we expressly permit through our public APIs.
- Probe, scan, or test the vulnerability of the Service without our prior written consent.
2.5 Account Integrity
- Create multiple accounts, share accounts, or use an account you do not own.
- Provide false identity information or impersonate any other person or entity.
- Use the Service on behalf of a person who has been previously suspended or terminated.
- Use any wallet balance, Premium subscription, or NFC sticker purchased by another user.
- Collude with other users to game referral, reward, or promotional programs.
2.6 Sanctions and Geography
- Provide the Service to, or transact with, any person, entity, or jurisdiction designated on the OFAC Specially Designated Nationals (SDN) List, the BIS Entity List, the BIS Denied Persons List, or any equivalent sanctions list.
- Use the Service from, or in connection with persons located in, comprehensively sanctioned jurisdictions (currently Cuba, Iran, North Korea, Syria, the Crimea / DNR / LNR regions of Ukraine).
3. Restricted Categories
The following categories require pre-approval and verification before use:
- Charitable solicitations must be registered with the Missouri Attorney General under Mo. Rev. Stat. § 407.250 et seq. (or the equivalent in your state) before transacting.
- Regulated money services (e.g., money transmission, currency exchange) require a valid state license.
- Peer-to-peer crypto on-ramps or off-ramps are not currently supported.
3.1. Additional Examples of Prohibited Conduct
The following non-exhaustive examples illustrate the prohibitions in Section 2. They are provided to help you understand what we will not tolerate; their inclusion does not limit the scope of Section 2 and does not create a safe harbor for conduct not listed.
- Romance scams, "pig-butchering" investment fraud, and impersonation of government officials, banks, or tech-support agents. We may freeze suspected-fraud funds and require a sworn statement of loss before releasing them.
- Use of multiple accounts, "mule" intermediaries, or pass-through wallets to disguise the source or destination of funds.
- Transactions that lack a legitimate personal, family, or household purpose, including the use of personal accounts for what is in substance a business.
- The purchase, sale, or transfer of Allospend accounts, Premium subscriptions, or NFC stickers for value outside our official channels.
- Bypassing sanctions by transacting through relatives, corporate vehicles, or by misrepresenting geography or identity.
- Coordinating with other users to manipulate promotional rewards, referral bonuses, or leaderboards.
- Using NFC stickers as a covert payment-receiver redirector to disguise the recipient of a payment.
We will treat each item as if it were a violation of Section 2 for purposes of enforcement under Section 5.
4. Reporting Violations
If you become aware of any violation of this AUP, report it to us by:
- Emailing compliance@allospend.app with as much detail as possible (account IDs, transaction IDs, screenshots, URLs).
- Using the in-app "Report" feature on any user profile, transaction, or NFC sticker.
- Mailing a written notice to the address below.
We do not commit to review anonymous tips, but we will treat identifying reports as confidentially as permitted by law. We will not retaliate against good-faith reporters.
5. Enforcement
We may, at our sole discretion and without prior notice, take any of the following actions against a user who violates this AUP, in addition to any other remedies available at law:

A "fund freeze" means we may, consistent with the Uniform Commercial Code, the Electronic Fund Transfer Act (15 U.S.C. § 1693 et seq.) and applicable state unclaimed-property laws, delay or decline withdrawals while we complete an investigation, and we may, where required, deliver frozen or unclaimed balances to the appropriate state unclaimed-property administrator after the dormancy period.
5.1. Standard of Review and Notice
Except in cases of clear fraud, abuse, or imminent harm, we will provide a written notice of the alleged violation, the action we propose, and (where appropriate) an opportunity to cure or appeal before permanent action is taken. In emergencies — including suspected money laundering, sanctions violations, or CSAM — we may take immediate action and provide notice afterward.
5.2. Reversal of Unauthorized or Prohibited Transactions
We may reverse, block, or claw back any transaction that we determine, in our reasonable judgment, was unauthorized, prohibited by this AUP, prohibited by the Acceptable Use Policy of a downstream processor (e.g., Stripe, PayPal, Cash App, Venmo), or that we are required by law to reverse. You authorize us to debit your wallet balance or any future deposits to recover reversed amounts.
5.3. Cooperation with Law Enforcement
We cooperate with valid legal process, including grand-jury subpoenas, administrative subpoenas (e.g., from FinCEN or OFAC), search warrants, and court orders. Where lawfully permitted, we may notify you of a legal-process request so that you can seek a protective order. We may also make voluntary reports to NCMEC, the Internet Crime Complaint Center ("IC3"), and state Attorneys General, consistent with the Safer-To-Report-to-NCMEC Act and analogous state safe-harbor statutes.
5.4. No Liability for Good-Faith Enforcement
To the maximum extent permitted by law, Allospend is not liable to you or any third party for losses caused by our good-faith enforcement of this AUP, including losses arising from account suspension, fund freezes, or reporting to authorities.
6. Appeals
If you believe your account was suspended or terminated in error, you may appeal by emailing compliance@allospend.app within thirty (30) days of the action. Include your name, registered email, account ID, and a short statement of why you believe the action was wrong. We will respond within thirty (30) days. Appeal decisions are final and not subject to further review within Allospend, except as required by law.
7. Reservation of Rights
We reserve the right, but have no obligation, to monitor, scan, retain, and disclose User Content and transaction metadata:
- To comply with 18 U.S.C. § 2701 et seq. (Stored Communications Act) and other applicable law.
- To respond to subpoenas, warrants, and court orders.
- To investigate potential violations of the AUP, the Terms, or applicable law.
- To protect the rights, property, or safety of Allospend, our users, or the public.
We may, in our sole discretion, decline to process a transaction, block a transaction, or place a hold pending review.
8. No Waiver
Failure or delay in enforcing any provision of this AUP is not a waiver of our right to enforce that or any other provision in the future.
9. Relationship to Other Agreements
This AUP supplements the Terms of Service, the Privacy Policy, the AI Terms, the E-Sign Consent, the Age Verification Policy, and the Fee Schedule. In the event of a conflict between this AUP and the Terms of Service specifically with respect to prohibited uses, the AUP controls. Capitalized terms not defined here have the meanings given in the Terms of Service.
10. Severability
If any provision of this AUP is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law and the remaining provisions will remain in full force and effect.
11. Survival
The provisions of this AUP that by their nature should survive termination — including the prohibitions, our reporting and cooperation rights, the no-liability-for-good-faith-enforcement clause, and the dispute-resolution and governing-law provisions of the Terms of Service — survive any termination of your account.
